Terms of service

Operator note. This document describes how the software behaves. It is a starting point, not legal advice. Have it reviewed by a lawyer in your jurisdiction before launch, and delete this box once you have.

1. Who we are

GiveawayHub ("we", "the platform") operates a service that lets members create and join pooled giveaways. By creating an account you agree to these terms.

2. Eligibility

You must be at least 18 years old and legally able to enter a contract where you live. You are responsible for checking that using this service is lawful in your jurisdiction. One account per person. Accounts found to be duplicates may be suspended and their balances frozen pending review.

3. Your account

Keep your password to yourself. You are responsible for everything done through your account. Tell us immediately if you think somebody else has access to it. The details you give us — including your name and payout details — must be accurate and yours.

4. Your wallet

Your wallet balance is a record of what we owe you. It is not a bank account, it earns no interest, and it is not insured as a deposit. Deposits are credited only after we have verified them. We may hold, reverse or refuse a transaction where we reasonably suspect fraud, error or a breach of these terms.

5. Joining a giveaway

  • The entry fee is debited from your wallet when you join.
  • One entry per person per giveaway.
  • Entries are final. You cannot withdraw an entry once it is confirmed. The only automatic refund is the one described in section 7.
  • Joining does not guarantee a prize. The number of prizes and how winners are chosen are shown on each giveaway's page before you join.

6. How winners are chosen

Each giveaway declares its selection method up front, and that method cannot be changed once anyone has paid to enter.

  • Random draw: we shuffle every paid participant using a cryptographic random number generator and assign prize positions in order.
  • Leader selection: the leader chooses from the paid participant list within 24 hours of entries closing. If they do not, we draw at random.

A participant may hold only one prize position per giveaway. Prizes are credited to the winner's wallet when the giveaway completes and are not paid in any other form.

7. Refunds

If a giveaway is cancelled, or its deadline passes without reaching its required number of participants (at least 5), every paid entry is refunded in full to the member's wallet automatically. In that case the leader receives nothing and no platform fee is charged. Refunds go to your wallet, not to your original payment method.

8. Running a giveaway

If you create a giveaway you are its leader, and you agree that:

  • The description, rules and prizes you publish are honest and achievable.
  • You will not enter your own giveaway, create accounts to inflate participation, or arrange the result of a supposedly random draw.
  • Once somebody has paid, the entry fee, participant counts, prizes, deadline and selection mode are locked. You may still correct the name, description, rules, banner, category and visibility.
  • You may cancel while entries are open, which refunds everyone in full and pays you nothing.

9. Settlement and fees

When a giveaway completes, prizes are paid first, our platform fee is deducted from the collection, and the remainder is credited to the leader's wallet. The fee in force is shown on the how it works page and may change for future giveaways, never for one already running. Each giveaway is settled exactly once.

10. Withdrawals

The full withdrawal amount leaves your available balance when you request it. Withdrawal fees and minimums are shown before you confirm. If a withdrawal is rejected or cancelled, the entire amount including the fee is returned to your wallet. We may ask you to verify your identity before processing a payout, and we may decline a payout to an account that is not in your name.

11. What you may not do

  • Use the platform for money laundering or any other unlawful purpose.
  • Create multiple accounts, or use somebody else's payment details.
  • Publish content that is illegal, hateful, obscene or infringing.
  • Interfere with the service, probe it for weaknesses, or automate access to it.
  • Attempt to manipulate the outcome of any giveaway.

12. Suspension

We may suspend or close an account that breaches these terms, and withhold funds connected to a breach while we investigate. Where we do that, we will tell you why unless we are legally prevented from doing so.

13. Availability

We do not promise the service will be uninterrupted or error-free. We may change, suspend or discontinue parts of it. Where a change affects a giveaway already running, we will honour the terms that giveaway was published under.

14. Liability

To the extent the law allows, our liability to you is limited to the balance held in your wallet. We are not liable for indirect or consequential loss, or for a leader's conduct outside the platform.

15. Changes to these terms

We may update these terms. The date at the top changes when we do, and continuing to use the platform after that means you accept the update.
